ICE Probes OPT Visa Misuse

US Immigration and Customs Enforcement has identified around 10,000 foreign students, including several Indians, who allegedly claimed employment with highly suspect companies under the Optional Practical Training program. OPT allows F-1 student visa holders to work in the United States after graduation for 12 months, while STEM students may qualify for longer extensions.

Officials said the investigation found cases involving locked offices, inactive worksites, empty buildings, and companies with little visible business activity. Some firms allegedly listed hundreds of OPT workers while operating with limited staff or unclear business operations.

Shell Companies Under Scanner

ICE suspects that some employers may have functioned as shell companies created mainly to issue employment records and help students maintain legal visa status. Authorities also found cases where OPT workers were allegedly managed by India-based HR representatives, raising compliance concerns.

The crackdown is important because OPT is a major bridge between US student visas and long-term work options such as H-1B sponsorship. Indian students are among the largest users of the program, especially in technology, consulting, and engineering fields.
